File through the Kansas Business Center. The articles name a resident agent with a Kansas street address. The information report is due in odd or even years depending on the formation year; an LLC that skips it is forfeited after 90 days and pays a reinstatement fee to come back.

Kansas does not register assumed names, so an LLC or sole proprietor may trade under another name without a state filing. Ask the county clerk whether the county keeps a trade name register; most do not. Banks and the liquor and food applications ask for the name you trade under, so keep it consistent.

Register for taxOpens after step 1
Register through the Kansas Customer Service Center (or mail form CR-16 three to four weeks before opening). The same application opens the sales tax, withholding and liquor drink tax accounts, and the retailers’ sales tax registration certificate must be posted. Prepared food and most retail sales are taxed at the state rate plus the city and county rates.

Kansas has no statewide business license. The city is where the liquor occupation tax, the cereal malt beverage license and any pet, kennel or home occupation permit are filed, so ask the clerk before signing the lease.

Approve the spaceOpens after step 2
Confirm the zoning allows your use before signing; a change of use needs building permits and inspections, and the certificate of occupancy comes before the food license inspection and the liquor license. Kansas has no statewide building code, so the city’s adopted code and fire code govern.

Kansas licenses restaurants, bars, coffee shops, bakeries and ice cream shops at the state level, not through the county health department. Apply with the floor plan before building out, pass the opening inspection, then post the license. Renewals in April add a late fee and a license lapsed past April 30 starts over with a new application. Ask Food Safety and Lodging for the current yearly fee for your square footage before budgeting.

Kansas does not require a certified food protection manager; the person in charge must instead show knowledge of food safety at each inspection, and holding an accredited certificate is one of the ways to do that. The Department recommends it, and a certificate short-cuts the inspector’s questions. Some cities add a local food handler rule.

Alcohol permitsOpens after step 4
Liquor by the drink is a county option: the premises must be in a county that approved it, and in counties that kept the rule at least 30% of gross receipts must come from food or the license is cancelled and the place becomes a Class B club. Apply with the lease (nine months left), the owners’ disclosures, a tax clearance and the food sales form; applicants must be 21 and have lived in Kansas for a year. There is no quota. Beer-only places can take the city’s cereal malt beverage license instead; half the state fee may be paid up front and the rest within a year.
