How to open a pizza shop in New York

9 licenses, permits and registrations, in the order to get them, each with the agency, the fee and the official page.

Draft. These 9 rows were drafted from the agencies' own pages in October 2026 and 1 still waits to be confirmed against the agency; one carries a note on what to check. Open the official page before you pay anything.

9 licenses, permits and registrations, in the order to get them

  1. Set up the business

    • Articles of organization (LLC) or a business certificate

An LLC keeps your personal assets apart from the business and is what landlords and lenders expect on a lease. New York’s publication step is the one people miss: without the certificate of publication the LLC’s authority to do business is suspended after 120 days.

  2. Register for tax

    • Sales tax Certificate of Authority

Apply at least 20 days before the first sale; nothing may be sold until the certificate arrives, and it is displayed at the counter. Operating without one can cost up to $10,000 in penalties.

  3. Approve the space

    • Certificate of occupancy or letter of no objection

Check the building’s certificate of occupancy before signing: if your use group matches and the exits are unchanged, a letter of no objection may be all a license needs; if the use changes (a store becoming a restaurant), plan for an architect’s filing, build-out and a new certificate. Outside the city, the town building inspector issues occupancy approval.

  4. Get the permits for your kind of business

    • Food service establishment permit

In the city, apply online, then either open 22 days after applying or call for a pre-operating inspection to open sooner; the permit follows a passed inspection. Outside the city, the county health department issues the permit after plan review.

    • Food Protection Certificate for the supervisor on duty

The New York City Health Code requires a supervisor holding the certificate on the premises whenever food is prepared or served. Outside the city, the state sanitary code requires a certified food manager under the county health department’s rules.

  5. Alcohol permits

    • On-premises liquor, wine or beer license

Notify the community board or town clerk 30 days before filing, then file with the lease, the floor plan and the owners’ disclosures; a full liquor license takes months and the 500-foot rule applies near three or more other licenses. A restaurant wine license (beer, wine and cider with full meals) is the fastest route.

    • Alcohol Training Awareness Program (ATAP) for staff

Voluntary in New York, but the Authority recommends it and a certified staff caps the civil penalty for a sale to a minor at $1,000 for a licensee with a clean five-year record. Cheap insurance for the license.

  6. Before the first hire

    • Employer registration for unemployment insurance and withholding (NYS-100)

One registration covers unemployment insurance, withholding and wage reporting; have the EIN first. New York also requires disability and paid family leave coverage and workers’ compensation from the first employee, through an insurer.
